My child, (named above), desires to participate in non-mandatory, extracurricular club activities, intramural sports and/or any other recreational activities at the facilities of the Holmen Viking Wrestling Club. In consideration of being allowed to participate via the Holmen Viking Wrestling Club, I hereby acknowledge and agree to the following:

I am fully informed or otherwise aware that my participation in this activity is voluntary. I am also fully informed or otherwise aware of and fully assume all risks to person and property in connection with my participation in this activity (including, but not limited to, damage and loss of property, bodily injury, medical treatment, and death). I am in good physical and mental health and do not have any physical or mental conditions which could affect my ability to participate in this activity. I have medical insurance coverage appropriate for my participation and, if requested, will provide evidence of such insurance coverage to the Holmen Viking Wrestling Club. The Holmen Viking Wrestling Club shall not provide any insurance for me in connection with my participation in any activity in which I choose of my own free will to engage.

I fully and forever RELEASE, WAIVE, and DISCHARGE, AND COVENANT NOT TO SUE, the Holmen Viking Wrestling Club (including, but not limited to, its trustees, employees, and representatives) from and for any and all demands, claims actions, suits, damages, losses, liabilities, costs and expenses arising, directly or indirectly, in connection with my participation in activities from any cause whatsoever (including, but not limited to damage, and loss of property, bodily injury, medical treatment, and death), whether or not foreseeable or contributed to by the negligent acts or omissions of the Holmen Viking Wrestling Club or others.

I shall INDEMNIFY AND HOLD HARMLESS the Holmen Viking Wrestling Club (including, but not limited to, its trustees, employees, and representatives) for and from any and all demands, claims, actions, suits, damages, losses, liabilities, costs, and expenses arising, directly or indirectly, as a result of my intentional or negligent acts or omissions from any cause whatsoever (including, but not limited to, damage and loss of property, bodily injury, medical treatment, and death), whether or not foreseeable or contributed to by the negligent acts or omissions of the Holmen Viking Wrestling Club or others.

I shall fully comply with all applicable laws, Holmen Viking Wrestling Club policies, and rules and regulations established by the Holmen Viking Wrestling Club or any third-party providing services regarding the activities while participating. If my participation in the activity is at any time deemed detrimental to me or any other participants, as determined by the Holmen Viking Wrestling Club in their sole discretion or any third-party providing services regarding the activities in their sole discretion, I understand that (i) I may be expelled or suspended from activities without the Holmen Viking Wrestling Club incurring any liability, (ii) I may incur liability to the Holmen Viking Wrestling Club under this Agreement, and (iii) I may be subject to further disciplinary action by the Holmen Viking Wrestling Club.

This Agreement constitutes the entire agreement and supersedes any prior or contemporaneous agreements, understandings, or negotiations with respect to the subject matter hereof. This Agreement (i) may not be amended or modified, by course of conduct or otherwise, and (ii) may not be assigned or transferred, in whole or in part, except in writing duly executed by the Holmen Viking Wrestling Club and me. This Agreement shall be governed by, and constructed and enforced in accordance with, the laws of the State of Wisconsin, without regard to the conflicts or choice of law principles thereof, and shall be as broad and inclusive as permitted by such laws. In the event that a court of competent jurisdiction shall hold any provision of this Agreement unenforceable, such unenforceability shall not affect any other provision, and this Agreement shall be constructed as if such provision, to the extent of such unenforceability, had never been incorporated herein.

I (i) have read and fully understand this Agreement, (ii) intend that this Agreement be legally binding upon and enforceable against me and my family members, estate, heirs, and legal representatives, (iii) intend that this Agreement insure to the benefit of the Holmen Viking Wrestling Club, and (iv) confirm that I am at least 18 years of age, fully competent, and entering into this Agreement voluntarily of my own judgment.

By participating in Holmen Viking Wrestling Club (HVWC) and associated team activities, you hereby grant HVWC permission to capture and use photographs or videos of you (or your minor child) for promotional purposes. These materials may be used in print and digital formats, including but not limited to social media, websites, flyers, and other promotional materials. Additionally, by sharing photos or videos on the team’s communication app, SportsYou, you consent to their use for the same promotional purposes. If you do not wish for your image (or your child’s image) to be used, please notify holmenvikingwrestlingclub@gmail.com.

Knowing the dangers, I hereby voluntarily represent and agree to waive and release and forever discharge and agree not to sue and to indemnify and hold harmless the Holmen Viking Wrestling Club, Activities Department or any of its representatives and/its assignees, Holmen Viking Wrestling Club and their governing boards, officers, agents, employees and volunteers from and against any and all liabilities, claims, demands, and causes of action of any kind on account of any loss, damage, illness or injury to person or property in any way arising out of or relating to my child’s/children’s participation in the School in and returning from the Holmen Viking Wrestling Club, Activities Department, related programs or specified activities, whether due to the negligence, mistake or other action or inaction of the Holmen Viking Wrestling Club staff, or any other person or entity involved in any way with the Holmen Viking Wrestling Club.
